WAIVER, RELEASE AND ASSUMPTION OF RISK FORM
This form is an important legal document. It explains the risks you are assuming by participating in the aerial tutorial programs created by Suspended Fluidity, LLC, an Arizona limited liability company.
Assumption Of Risk
I, the purchaser and/or member, understand that aerial dance is an inherently dangerous activity that could potentially result in serious injury or death. I understand that because aerial dance can be difficult and/or strenuous, I am advised to consult with a medical professional prior to engaging in any such activity. I understand that the aerial tutorial programs offered by Suspended Fluidity, LLC, are intended for use only as a tool of reference for individuals with substantial aerial experience. I understand and acknowledge that I should only engage in aerial dance under the direct supervision of a trained professional, and with appropriate safety apparatus. I acknowledge and agree that I voluntarily assume all risks associated with any and all aerial activities and/or exercises in which I participate.
Waiver, Informed Consent And Covenant Not To Sue
I, the purchaser and/or member, hereby forever release, discharge and hold harmless Suspended Fluidity, LLC, and its successors, assigns, members, officers, employees, representatives, and agents from any/all claims, demands, damages, or causes of action of any nature whatsoever, known or unknown, present or future, which may arise out of, or relate to, any injury, loss or damage to person or property that may be sustained as a result of my participation in any aerial dance activity. I understand that this release and covenant not to sue shall be binding upon myself and my heirs, successors, administrators, personal representatives, executors, agents and assigns.
I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER, RELEASE AND ASSUMPTION OF RISK FORM, AND THAT I FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. THIS DOCUMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN MYSELF AND SUSPENDED FLUIDITY, LLC, IT SUPERSEDES ANY PRIOR ORAL OR WRITTEN AGREEMENTS OR UNDERSTANDINGS, AND IT CANNOT BE ALTERED, AMENDED OR MODIFIED, EXCEPT BY A WRITTEN DOCUMENT SIGNED BY SUSPENDED FLUIDITY, LLC. IF ANY PROVISION OF THIS FORM IS DEEMED INVALID, IT SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHE PROVISION. THE TERMS OF THIS AGREEMENT SHALL BE CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ARIZONA.
